These terms apply to everyone who uses Fiig: on a free or a paid plan, through fiig.io, the API or the WordPress plugin. We kept them as short and clear as we could. If anything is unclear, email us at [email protected].
This is a translation. If the Dutch and the English version differ, the Dutch one applies.
1. Who we are
Fiig is a product of Miix, the sole proprietorship of Fred Klopper, Groningensingel 51-45, 6835 EB Arnhem, the Netherlands, Chamber of Commerce number 09114618. "We" means Miix; "you" means whoever has an account with Fiig. A subscription belongs to a workspace; the workspace owner is our customer and enters into the agreement, also on behalf of their team.
Only these terms apply to Fiig. The general terms of Miix for custom work and hosting don't, unless we do separate custom work for you. Your own terms don't apply.
2. Your account
- You're at least 16 years old and give us correct details.
- You keep your password, recovery codes and API keys secret. What happens with your account or keys is your responsibility, also when team members do it.
- You can always delete an account without a subscription, under Account → Delete account.
3. The beta
While Fiig is in beta, everything is free and without limits. Features may still change. We'll tell you at least 30 days before the beta ends. If you create an account during the beta, you get 50% off the first year of a paid plan, counted from the first payment.
4. Plans and opens
- The plans, what's in them and what they cost are on the pricing page. Every plan includes every widget.
- An open is each time an email program fetches a widget. Opens count per calendar month; on the 1st the counter starts at zero again.
- If you go over your plan's limit, your widgets keep working. You get a message at 80% and at 100%. If you're far over your limit every month, we'll ask you to choose a plan that fits.
5. Prices and payment
- Prices include 21% VAT. If you're a business in another EU country with a valid VAT number, you pay without VAT (reverse charge).
- You pay monthly or yearly, in advance. You make the first payment with iDEAL, which authorizes us to collect the next terms automatically (SEPA direct debit). Payments go through Mollie. After each payment you get an invoice by email.
- If a payment fails, we'll let you know. If it's still unpaid after 14 days, your workspace goes back to Free. Your widgets keep working, with Free's limits.
- If prices change, you'll hear at least 30 days in advance. The new price applies from your next term; if you don't want that, you can cancel before then.
6. Changing and cancelling
- Moving to a bigger plan happens right away; the unused part of your current term comes off the first payment.
- Moving to a smaller plan and cancelling take effect at the end of the term you paid for. A monthly plan can be cancelled every month; a yearly plan runs to the end of the year. What you already paid isn't refunded (except when you withdraw, below).
- You can cancel in your account or by email to [email protected]. After cancelling you go back to Free; your account and widgets stay until you delete them.
7. Cooling-off period for consumers
If you take a paid plan as a private person, you may withdraw from the agreement within 14 days of your first payment, without giving a reason. Email [email protected] with your name, your Fiig email address and the date of your first payment. You get the full amount back within 14 days, the same way you paid, even if you already used Fiig. Your workspace then goes back to Free.
8. What you make with Fiig
- You're responsible for what you put in your widgets: texts, links and images. They stay yours; you only allow us to store and show them as far as Fiig needs to.
- Don't use Fiig for anything that isn't allowed: spam, phishing, deception, fraud, hate, infringing others' rights or links to harmful software. If that happens, we may block the widget or the account. Where we can, we'll warn you first.
- Fiig itself (the software, the design and the widgets as a product) stays ours. The fonts are open source; their licenses are included in Fiig.
9. Availability
We do our best to keep Fiig available at all times, but can't promise it never has an outage. We do maintenance at quiet moments where we can. Email programs treat images differently (Outlook shows only the first frame, Apple Mail sometimes fetches images on delivery, some readers turn images off); that's beyond our control. More in the FAQ.
Widgets in emails you already sent keep working as long as the widget exists. If you delete a widget or your account, the image in those emails shows nothing anymore.
10. Liability
- If we're liable for damage, it's at most the amount you paid for Fiig in the 12 months before. We're not liable for consequential damage, such as lost revenue or a mailing that turned out differently.
- These limits don't apply in case of intent or gross negligence on our side. If you're a private person, you also keep all your statutory rights.
- Force majeure, such as an outage at our hosting or payment provider, doesn't entitle you to compensation.
11. Privacy
How we handle data is in the privacy statement. Fiig stores no data about the readers of your emails: we count opens and votes only as totals, without IP addresses or email addresses. If you still need a data processing agreement, email us.
12. If we stop or end your account
- If you don't follow these terms or don't pay, we may limit or end your account after a warning. In case of serious abuse, right away.
- If we stop Fiig, we'll tell you at least 3 months in advance and refund the part of your subscription you can no longer use.
13. New versions of these terms
We may change these terms. For important changes you get an email at least 30 days in advance. If you don't agree, you can cancel before they take effect.
14. Law and disputes
Dutch law applies to Fiig. If we can't work it out together, a dispute goes to the court of Gelderland (Arnhem). If you're a private person, you may also go to the court where you live.
